TUPE transfers
TUPE transfers
TUPE refers to the Transfers of Undertakings (Protection of Employment) Regulations 2006. The regulations set out the rules that help protect employee rights when their jobs are transferred to a new employer.
When we have revised TUPE regulations, we will update you. Please contact the employer helpline on 0161 301 7200 for the latest information on the TUPE process.
In the majority of cases, we will require leaver forms from the old employer and new starter notifications from the new employer for all staff involved in a compulsory transfer.
You should consider the impact of the Best Value Direction 2007 or Fair Deal when considering any staff transfer from central government. You must seek your own legal advice regarding procurement and employment law.
If you are an employer who needs to join GMPF to protect pension provision, because staff are being compulsory transferred to you from an existing GMPF employer, you need to read the further information in our applying to join GMPF section.
